Sean “Diddy” Combs’ legal team has launched serious accusations against federal prosecutors, alleging that they violated his attorney-client confidentiality by seizing and reviewing privileged materials during his pretrial detention. The controversy is the latest in the high-profile case against the music mogul, who faces charges of sex trafficking and racketeering.
Combs’ attorneys claim that a recent raid on his cell at the Metropolitan Detention Center in Brooklyn resulted in the government photographing personal notes meant for his legal team without his consent or judicial approval. The defense argues that this intrusion undermines his ability to prepare for his May 2025 trial.
Explosive Allegations
“The government is using Mr. Combs’ detention to spy on him and invade his confidential communications with his counsel,” the defense stated in a filing obtained by media outlets. They assert that the materials seized included a notebook, an address book, and a folder labeled “legal.”
Prosecutors, however, have denied any misconduct, insisting the raid was a routine security sweep and not targeted specifically at Combs. They claim that any photographed materials were reviewed by a neutral “filter team” to ensure no privileged information reached prosecutors.
Still, Combs’ legal team remains adamant that the government acted improperly. “This disturbing conduct is a blatant violation of Mr. Combs’ rights,” they said, adding that the justification of “security concerns” was a false pretext.
Judge’s Intervention
In response to the allegations, Judge Arun Subramanian held an emergency hearing on November 19. While he did not grant Combs bail, the judge ordered prosecutors to destroy any copies of privileged notes taken during the raid, marking a partial victory for the defense.
The judge’s directive, however, did not resolve broader tensions. Combs’ team continues to argue that the alleged misconduct has irreparably compromised his ability to mount a fair defense, with his attorneys stating, “Mr. Combs cannot possibly receive a fair trial if he is not permitted to confer privately and confidentially with his counsel.”

The defense has also criticized the government’s broader approach to the case, describing it as an aggressive attempt to exploit Combs’ incarceration. The team has pushed for his release on a $50 million bond, citing the need for in-home detention to allow adequate trial preparation.
Prosecutors, however, maintain that Combs’ detention is necessary due to his potential danger to the public and flight risk. They have yet to address the spying allegations in detail, further fueling tensions between both sides as the trial date looms.
